The whole political system needs to be re-evaluated. I believe that all the leaders need to go. You can’t say farmaajo has to go while excusing Deni, madobe, hsm, sheikh sharif and AAS. If these men and the majority of the people under them go then we can move forward. Somalia can easily have a chokehold on the entirety of east Africa if we have 15 yrs of peace and real governance. Laakin certain users throw tantrums when I say that you shouldn’t hold a position of power without a degree and being put in a position where you have something to lose. The country will only get better if the men leading us have incentives to improve ( no foreign passports, all their land and properties handed over to the govt and mandatory military service for their relatives). You think AAS would sell the sea if he had nowhere to run and the govt had control of his belongings? If the leaders kids where sent to the frontlines against AS these men would make sure that AS would be rooted out of every place that theyre in:manny: . My point is when you have everything to lose you’ll put in the upmost effort to improve and the ones that don’t want to improve the country won’t take the risk of running for a position

The International Court of Justice has denied Kenya request to address it before the start of maritime border case with Somalia.

Kenya had on March 11 requested the court to grant it 30 minutes to address the judges on why it will not participate in the case.

On Sunday Kenya’s Foreign Affairs Ministry had said it will issue a statement on Kenya’s stand on the maritime dispute with Somalia that is before the ICJ.

A senior government official yesterday told The Standard that the ministry will be expressing displeasure with how the court is handling the case.

Kenya’s latest stand that it will not participate in the hearing today came after a week-long meeting held between government agencies and lawyers and the biggest concern was ICJ’s decision to hear the case despite protests on the impartiality of judges and the effects of Covid-19 on preparation of the case.

“Kenya believes that agreements must be performed in good faith. Kenya has always maintained its position that it did not consent to the court’s jurisdiction over disputes where it had agreed to other methods of settlement including the Memorandum of Understanding (“MoU”) of April 7, 2009,” the official said on condition of anonymity.

Yesterday, the government was still weighing the ramifications of failing to appear as it had already taken a position that the ICJ was partial and it will only be ratifying Somalia’s claim to the contested area.

The government official asserted that nothing or anyone will alter Kenya’s maritime boundary, an indicator that the government may ignore ICJ’s decision and root for other options to defend herself.

He said: “It is important to emphasise and reassure the Kenyan citizens that the country’s sovereignty is not threatened at all nor will it be altered as a result of the court’s decision. The case, in particular, is aligned to the country’s sovereignty and territorial integrity. The outcome of the case further has a direct bearing on the national security of the country, a matter not taken lightly by the citizens of the Republic.”

Kenya is aggrieved that Somalia is emboldened by the fact that it has ‘friends of Kenya’ on Mogadishu’s list of those who have purchased oil wells in the contested area for exploration. Also at the heart of Kenya’s protest is the presence of Justice Abdulqawi Ahmed Yusuf in the case. Ahmed is a Somali national.

Kenya’s maritime area is approximately 255,000km, which was determined through the parallel of latitudes in 1979.

UN court 'regrets' Kenya snub in Somalia case

The UN's top court allowed Somalia's case to go ahead in a long-running maritime dispute with Kenya Monday, saying it regretted Nairobi's refusal to attend.

Kenya announced earlier that it would snub this week's International Court of Justice hearings after the Hague-based court refused to allow further delays in the case.

Somalia has asked the ICJ to rule in the dispute, potentially deciding control over a large Indian Ocean zone that is rich in fish and which might contain substantial crude oil reserves.


"The court regrets the decision of Kenya not to participate in the oral proceedings," ICJ President Joan Donoghue said.

But the court would go ahead with hearing Somalia's case, and would use written evidence provided by Kenya instead, Donoghue said.

Somalia criticised Kenya's "defiance" of the ICJ, which was set up after World War II to rule in disputes between UN member states.

"We are deeply concerned that Kenya has decided not to appear at these hearings," sad Mahdi Mohammed Gulaid, opening Somalia's case.

He said it was "inconsistent with the rule of law" and Kenya's commitment to the court.

Kenya "has no grounds to complain about its treatment by the court" after the ICJ granted three previous requests for delays that held up the case by 18 months, he said.

- 'Regrettable decision' -

"Fortunately this regrettable decision to boycott the oral hearings cannot prevent them proceeding, nor can Kenya's defiance prevent the court from fulfilling its mission," added Gulaid.

The ICJ is hearing a case brought by Somalia in 2014.

Somalia, which lies northeast of Kenya, wants to extend its maritime frontier with Kenya along the line of the land border, in a southeasterly direction.

Kenya wants the border to head out to sea in a straight line east, giving it more territory.

The disputed triangle of water stretches over an area of more than 100,000 square kilometres (40,000 square miles).

Kenyan prosecutor Kihara Kariuki had earlier said in a letter his country would not be participating because the Covid-19 pandemic had "hampered Kenya's ability to prepare adequately for the hearing."

In its letter, Kenya also argued that holding the ICJ hearings virtually did not allow it to present its case in the most effective way.

The ICJ on Monday however dismissed Kenya's request for a "thirty minute opportunity to orally address the court before the commencement of the actual hearings."

Kenya recalled its ambassador to Somalia in February 2019 after accusing Somalia of selling oil and gas blocks at a London auction despite the pending delineation case before the ICJ.

Kenya also contested the ICJ's authority to rule in the case, but the court dismissed its objections in 2017.

How many times did the Kenyan intellectual class warn their gov about not messing up the relationship with the somali gov. The ic knows that the economic future of Somalia is bright. With Turkish highly trained special forces, the kdf will stand no chance in a future war when the arms embargo is lifted. A good proportion of our troops are highly trained drone operators. This alone is enough to keep the kdf on its knees.

As far as i can tell we prepared all options. With the maritime dispute legally settled we can use it to lobby the lifting of the arms embargo.
