It is not Either or but majority opinion and one Opposing opinion to the majority of Scholars. It is not Waajib based on Verse and Hadeeth. So that is the stronger opinion with the Nusuus. Mustaxab is not the same as Waajib. Niqab IS NOT required per Islam. If a woman finds it suitable, or some Sheekh thinks it is suitable, their views and feelings doesn't make Niqab WAAJIB.

1.It was narrated from Safiyyah bint Shaybah that ‘Aishah (may Allah be pleased with her) used to say: When these words were revealed – “and to draw their veils all over Juyubihinna (i.e. their bodies, faces, necks and bosoms)” – they took their izars (a kind of garment) and tore them from the edges and covered their faces with them. Narrated by al-Bukhari, 4481.

2.‘Aishah narrated that the wives of the Prophet (peace and blessings of Allah be upon him) used to go out at night to al-Manasi’ (well known places in the direction of al-Baqi’) to relieve themselves and ‘Umar used to say to the Prophet (peace and blessings of Allah be upon him), “Let your wives be veiled.” But the Messenger of Allah (peace and blessings of Allah be upon him) did not do that. Then one night Sawdah bint Zam’ah, the wife of the Prophet (peace and blessings of Allah be upon him), went out at ‘Isha time and she was a tall woman. ‘Umar called out to her: “We have recognized you, O Sawdah!” hoping that hijab would be revealed, then Allah revealed the verse of hijab. (Narrated by al-Bukhari, 146; Muslim, 2170)

3.‘Aishah narrated (may Allah be pleased with her) said: “The riders used to pass by us when we were with the Messenger of Allah (peace and blessings of Allah be upon him) in ihram, and when they drew near to us we would lower our jilbabs from our heads over our faces, then when they had passed we would uncover them again. (Narrated by Abu Dawud, 1833; Ibn Majah, 2935; classed as sahih by Ibn Khuzaymah (4,203) and by al-Albani in Kitab Jilbab al-Marah al-Muslimah)

4.Asma bint Abi Bakr said: We used to cover our faces in front of men. (Narrated by Ibn Khuzaymah, 4/203; al-Hakim, 1/624. He classed it as sahih and al-Dhahabi agreed with him. It was also classed as sahih by al-Albani in Jilbab al-Marah al-Muslimah.)

5.‘Asim al-Ahwal said: We used to enter upon Hafsah bint Sirin who had put her jilbab thus and covered her face with it, and we would say to her: May Allah have mercy on you. Allah says (interpretation of the meaning): “And as for women past childbearing who do not expect wedlock, it is no sin on them if they discard their (outer) clothing in such a way as not to show their adornment” [al-Nur 24:60]. And she would say to us: What comes after that? We would say: “But to refrain (i.e. not to discard their outer clothing) is better for them”. And she would say: That is confirming the idea of hijab. The Rulings of Hijab
This is a command from Allah to the believing women, and jealousy on His part over the wives of His believing servants. It is also to distinguish the believing women from the women of the Jahiliyyah and the deeds of the pagan women. The reason for the revelation of this Ayah was mentioned by Muqatil bin Hayyan, when he said: "We heard -- and Allah knows best -- that Jabir bin `Abdullah Al-Ansari narrated that Asma' bint Murshidah was in a house of hers in Bani Harithah, and the women started coming in to her without lower garments so that the anklets on their feet could be seen, along with their chests and forelocks. Asma' said: `How ugly this is!' Then Allah revealed:

وَقُل لِّلْمُؤْمِنَـتِ يَغْضُضْنَ مِنْ أَبْصَـرِهِنَّ
(And tell the believing women to lower their gaze...)" And Allah says:

وَقُل لِّلْمُؤْمِنَـتِ يَغْضُضْنَ مِنْ أَبْصَـرِهِنَّ
(And tell the believing women to lower their gaze) meaning, from that which Allah has forbidden them to look at, apart from their husbands. Some scholars said that it is permissible for women to look at non-Mahram men without desire, as it was recorded in the Sahih that the Messenger of Allah was watching the Ethiopians playing with spears in the Masjid on the day of `Id, and `A'ishah the Mother of the believers was watching them from behind him and he was concealing her from them, until she got bored and went away.

وَيَحْفَظْنَ فُرُوجَهُنَّ
(and protect their private parts). Sa`id bin Jubayr said: "From immoral actions." Abu Al-`Aliyah said: "Every Ayah of the Qur'an in which protecting the private parts is mentioned means protecting them from Zina, except for this Ayah --

وَيَحْفَظْنَ فُرُوجَهُنَّ
(and protect their private parts), which means protecting them from being seen by anybody."

وَلاَ يُبْدِينَ زِينَتَهُنَّ إِلاَّ مَا ظَهَرَ مِنْهَا
(and not to show off their adornment except that which is apparent,) means, they should not show anything of their adornment to non-Mahram men except for whatever it is impossible to hide. Ibn Mas`ud said: "Such as clothes and outer garments," Meaning what the Arab women used to wear of the veil which covered their clothes and whatever showed from underneath the outer garment. There is no blame on her for this, because this is something that she cannot conceal. Similar to that is what appears of her lower garment and what she cannot conceal. Al-Hasan, Ibn Sirin, Abu Al-Jawza', Ibrahim An-Nakha`i and others also had the same view as Ibn Mas`ud.

وَلْيَضْرِبْنَ بِخُمُرِهِنَّ عَلَى جُيُوبِهِنَّ
(and to draw their veils all over their Juyub) means that they should wear the outer garment in such a way as to cover their chests and ribs, so that they will be different from the women of the Jahiliyyah, who did not do that but would pass in front of men with their chests completely uncovered, and with their necks, forelocks, hair and earrings uncovered. So Allah commanded the believing women to cover themselves, as He says:

يأَيُّهَا النَّبِىُّ قُل لاًّزْوَجِكَ وَبَنَـتِكَ وَنِسَآءِ الْمُؤْمِنِينَ يُدْنِينَ عَلَيْهِنَّ مِن جَلَـبِيبِهِنَّ ذلِكَ أَدْنَى أَن يُعْرَفْنَ فَلاَ يُؤْذَيْنَ
(O Prophet! Tell your wives and your daughters and the women of the believers to draw their cloaks all over their bodies. That will be better, that they should be known, so as not to be annoyed) 33:59 And in this noble Ayah He said:

وَلْيَضْرِبْنَ بِخُمُرِهِنَّ عَلَى جُيُوبِهِنَّ
(and to draw their (Khumur) veils all over their Juyub) Khumur (veils) is the plural of Khimar, which means something that covers, and is what is used to cover the head. This is what is known among the people as a veil. Sa`id bin Jubayr said:

(and to draw) means to pull it around and tie it securely.

بِخُمُرِهِنَّ عَلَى جُيُوبِهِنَّ
(their veils all over their Juyub) means, over their necks and chests so that nothing can be seen of them. Al-Bukhari recorded that `A'ishah, may Allah be pleased with her, said: "May Allah have mercy on the women of the early emigrants. When Allah revealed the Ayah:

وَلْيَضْرِبْنَ بِخُمُرِهِنَّ عَلَى جُيُوبِهِنَّ
(and to draw their veils all over their Juyub), they tore their aprons and Akhtamar themselves with them." He also narrated from Safiyyah bint Shaybah that `A'ishah, may Allah be pleased with her, used to say: "When this Ayah:

وَلْيَضْرِبْنَ بِخُمُرِهِنَّ عَلَى جُيُوبِهِنَّ

Here Allah tells His Messenger to command the believing women -- especially his wives and daughters, because of their position of honor -- to draw their Jilbabs over their bodies, so that they will be distinct in their appearance from the women of the Jahiliyyah and from slave women. The Jilbab is a Rida', worn over the Khimar. This was the view of Ibn Mas`ud, `Ubaydah, Qatadah, Al-Hasan Al-Basri, Sa`id bin Jubayr, Ibrahim An-Nakha`i, `Ata' Al-Khurasani and others. It is like the Izar used today. Al-Jawhari said: "The Jilbab is the outer wrapper. `Ali bin Abi Talhah reported that Ibn `Abbas said that Allah commanded the believing women, when they went out of their houses for some need, to cover their faces from above their heads with the Jilbab, leaving only one eye showing. Muhammad bin Sirin said, "I asked `Ubaydah As-Salmani about the Ayah:

يُدْنِينَ عَلَيْهِنَّ مِن جَلَـبِيبِهِنَّ
(to draw their Jalabib over their bodies.) He covered his face and head, with just his left eye showing."

(And Allah is Ever Oft-Forgiving, Most Merciful.) means, with regard to what happened previously during the days of Jahiliyyah, when they did not have any knowledge about this.

And tell believing women to lower their gaze away from what is not lawful for them to look at and to guard their private parts from what is not lawful for them to do with them and not to display their adornment except for what is apparent namely the face and the hands which may be seen by a stranger when there is no danger of either or both falling into temptation — this being one of two opinions. The second of these is that even this is forbidden because there is a presumption that these parts will cause temptation — and this is the preferred opinion if one must settle this topic with a definitive opinion; and let them draw their veils over their bosoms that is let them cover up their heads necks and chests with veils and not reveal their hidden adornment namely all that is other than the face and the hands except to their husband

O Prophet! Tell your wives and daughters and the women of the believers to draw their cloaks closely over themselves jalābīb is the plural of jilbāb which is a wrap that covers a woman totally — in other words let them pull part of it also over their faces leaving one eye visible when they need to leave the house for something. That makes it likelier that they will be known to be free women and not be molested by being approached. In contrast slavegirls did not use to cover their faces and so the disbelievers used to pester them. And God is Forgiving of any occasion in the past when they may have neglected to cover themselves Merciful to them in His veiling them.

يَا أَيُّهَا النَّبِيُّ قُل لِّأَزْوَاجِكَ وَبَنَاتِكَ وَنِسَاءِ الْمُؤْمِنِينَ يُدْنِينَ عَلَيْهِنَّ مِن جَلَابِيبِهِنَّ

O Prophet, tell your wives, your daughters, and the believing women to lower their garments over themselves.

Surat al-Ahzab 33:59

It is reported from Ibn Abbas (ra) that he explained this verse, saying:

أمر الله نساء المؤمنين إذا خرجن من بيوتهن في حاجة أن يغطين وجوههن من فوق رءوسهن بالجلابيب ويبدين عينا واحدة

Allah commanded the believing women, when they leave their houses for a need, to veil their faces from above their heads with their cloaks and let one eye appear.

Since you donot know what tafseer atabari is let me inform you, that all it does is collect narrations of the sahaba and salaf concerning an ayah, so every thing you see here is a narration from a hadith, you cannot read arabic, but im sure some people here can, and you can see by the translation that it clearly mentions every part of the body is awrah for a woman except face and palms, some say the face is part of awrah aswell, although this is a minority opinion it still has valid evidence

وكفيها في صلاتها، وأن عليها أن تستر ما عدا ذلك من بدنها، إلا ما روي عن النبي صلى الله عليه وسلم أنه أباح لها أن تبديه من ذراعها إلى قدر النصف. فإذا كان ذلك من جميعهم إجماعا، كان معلوما بذلك أن لها أن تبدي من بدنها ما لم يكن عورة، كما ذلك للرجال; لأن ما لم يكن عورة فغير حرام إظهاره؛ وإذا كان لها إظهار ذلك، كان معلوما أنه مما استثناه الله تعالى ذكره، بقوله: ( إِلا مَا ظَهَرَ مِنْهَا ) لأن كل ذلك ف[ ص: 210 ] وفي الخبر ( النظر سهم من سهام إبليس مسموم فمن غض بصره أورثه الله الحلاوة في قلبه ) . وقال مجاهد : إذا أقبلت المرأة جلس الشيطان على رأسها فزينها لمن ينظر ؛ فإذا أدبرت جلس على عجزها فزينها لمن ينظر . وعن خالد بن أبي عمران قال : لا تتبعن النظرة النظرة فربما نظر العبد نظرة نغل منها قلبه كما ينغل الأديم فلا ينتفع به . فأمر الله سبحانه وتعالى المؤمنين والمؤمنات بغض الأبصار عما لا يحل ؛ فلا يحل للرجل أن ينظر إلى المرأة ولا المرأة إلى الرجل ؛ فإن علاقتها به كعلاقته بها ؛ وقصدها منه كقصده منها . وفي صحيح مسلم ، عن أبي هريرة قال : سمعت رسول الله - صلى الله عليه وسلم - يقول : إن الله كتب على ابن آدم حظه من الزنا أدرك ذلك لا محالة فالعينان تزنيان وزناهما النظر . . . الحديث . وقال الزهري في النظر إلى التي لم تحض من النساء : لا يصلح النظر إلى شيء منهن ممن يشتهى النظر إليهن وإن كانت صغيرة . وكره عطاء النظر إلى الجواري اللاتي يبعن بمكة إلا أن يريد أن يشتري . وفي الصحيحين عنه - عليه السلام - أنه صرف وجه الفضل عن الخثعمية حين سألته ، وطفق الفضل ينظر إليها . وقال : عليه السلام - : الغيرة من الإيمان والمذاء من النفاق . والمذاء هو أن يجمع الرجل بين النساء والرجال ثم يخليهم يماذي بعضهم بعضا ؛ مأخوذ من المذي . وقيل : هو إرسال الرجال إلى النساء ؛ من قولهم : مذيت الفرس إذا أرسلتها ترعى . وكل ذكر يمذي ، وكل أنثى تقذي ؛ فلا يحل لامرأة تؤمن بالله واليوم الآخر أن تبدي زينتها إلا لمن تحل له ؛ أو لمن هي محرمة عليه على التأبيد ؛ فهو آمن أن يتحرك طبعه إليها لوقوع اليأس له منها .الثانية : روى الترمذي ، عن نبهان مولى أم سلمة أن النبي - صلى الله عليه وسلم - قال لها ولميمونة وقد دخل [ ص: 211 ] عليها ابن أم مكتوم : احتجبا فقالتا : إنه أعمى ، قال : أفعمياوان أنتما ألستما تبصرانه . فإن قيل : هذا الحديث لا يصح عند أهل النقل ؛ لأن راويه عن أم سلمة نبهان مولاها وهو ممن لا يحتج بحديثه . وعلى تقدير صحته فإن ذلك منه - عليه السلام - تغليظ على أزواجه لحرمتهن كما غلظ عليهن أمر الحجاب ؛ كما أشار إليه أبو داود وغيره من الأئمة . ويبقى معنى الحديث الصحيح الثابت وهو أن النبي - صلى الله عليه وسلم - أمر فاطمة بنت قيس أن تعتد في بيت أم شريك ؛ ثم قال : تلك امرأة يغشاها أصحابي اعتدي عند ابن أم مكتوم فإنه رجل أعمى تضعين ثيابك ولا يراك . قلنا : قد استدل بعض العلماء بهذا الحديث على أن المرأة يجوز لها أن تطلع من الرجل على ما لا يجوز للرجل أن يطلع من المرأة كالرأس ومعلق القرط ؛ وأما العورة فلا . فعلى هذا يكون مخصصا لعموم قوله تعالى : وقل للمؤمنات يغضضن من أبصارهن ، وتكون من للتبعيض كما هي في الآية قبلها . قال ابن العربي : وإنما أمرها بالانتقال من بيت أم شريك إلى بيت ابن أم مكتوم لأن ذلك أولى بها من بقائها في بيت أم شريك ؛ إذ كانت أم شريك مؤثرة بكثرة الداخل إليها ، فيكثر الرائي لها ، وفي بيت ابن أم مكتوم لا يراها أحد ؛ فكان إمساك بصرها عنه أقرب من ذلك وأولى ، فرخص لها في ذلك ، والله أعلم .الثالثة : أمر الله سبحانه وتعالى النساء بألا يبدين زينتهن للناظرين ، إلا ما استثناه من الناظرين في باقي الآية حذارا من الافتتان ، ثم استثنى ما يظهر من الزينة ؛ واختلف الناس في قدر ذلك ؛ فقال ابن مسعود : ظاهر الزينة هو الثياب . وزاد ابن جبير الوجه . وقال سعيد بن جبير أيضا ، وعطاء ، والأوزاعي : الوجه والكفان والثياب . وقال ابن عباس ، وقتادة ، والمسور بن مخرمة : ظاهر الزينة هو الكحل ، والسوار ، والخضاب إلى نصف الذراع ، والقرطة ، والفتخ ؛ ونحو هذا فمباح أن تبديه المرأة لكل من دخل عليها من الناس . وذكر الطبري ، عن قتادة في معنى نصف الذراع حديثا عن النبي - صلى الله عليه وسلم - ، وذكر آخر عن عائشة - رضي الله عنها - عن النبي - صلى الله عليه وسلم - أنه قال : لا [ ص: 212 ] يحل لامرأة تؤمن بالله واليوم الآخر إذا عركت أن تظهر إلا وجهها ويديها إلى هاهنا وقبض على نصف الذراع . قال ابن عطية : ويظهر لي بحكم ألفاظ الآية أن المرأة مأمورة بألا تبدي وأن تجتهد في الإخفاء لكل ما هو زينة ، ووقع الاستثناء فيما يظهر بحكم ضرورة حركة فيما لا بد منه ، أو إصلاح شأن ونحو ذلك . ف ( ما ظهر ) على هذا الوجه مما تؤدي إليه الضرورة في النساء فهو المعفو عنه .قلت : هذا قول حسن ، إلا أنه لما كان الغالب من الوجه والكفين ظهورهما عادة وعبادة وذلك في الصلاة والحج ، فيصلح أن يكون الاستثناء راجعا إليهما . يدل على ذلك ما رواه أبو داود ، عن عائشة - رضي الله عنها - أن أسماء بنت أبي بكر - رضي الله عنهما - دخلت على رسول الله - صلى الله عليه وسلم - وعليها ثياب رقاق ، فأعرض عنها رسول الله - صلى الله عليه وسلم - وقال لها : يا أسماء إن المرأة إذا بلغت المحيض لم يصلح أن يرى منها إلا هذا وأشار إلى وجهه وكفيه . فهذا أقوى من جانب الاحتياط ؛ ولمراعاة فساد الناس فلا تبدي المرأة من زينتها إلا ما ظهر من وجهها وكفيها ، والله الموفق لا رب سواه . وقد قال ابن خويز منداد من علمائنا : إن المرأة إذا كانت جميلة وخيف من وجهها وكفيها الفتنة فعليها ستر ذلك ؛ وإن كانت عجوزا أو مقبحة جاز أن تكشف وجهها وكفيها .الرابعة : الزينة على قسمين : خلقية ومكتسبة ؛ فالخلقية وجهها فإنه أصل الزينة وجمال الخلقة ومعنى الحيوانية ؛ لما فيه من المنافع وطرق العلوم . وأما الزينة المكتسبة فهي ما تحاوله المرأة في تحسين خلقتها ؛ كالثياب ، والحلي ، والكحل ، والخضاب ؛ ومنه قوله تعالى : خذوا زينتكم . وقال الشاعر :يأخذن زينتهن أحسن ما ترى وإذا عطلن فهن خير عواطلالخامسة : من الزينة ظاهر وباطن ؛ فما ظهر فمباح أبدا لكل الناس من المحارم والأجانب ؛ وقد ذكرنا ما للعلماء فيه . وأما ما بطن فلا يحل إبداؤه إلا لمن سماهم الله تعالى في هذه الآية ، أو حل محلهم . واختلف في السوار ؛ فقالت عائشة : هي من الزينة الظاهرة لأنها في اليدين . وقال مجاهد : هي من الزينة الباطنة لأنها خارج عن الكفين وإنما تكون في الذراع . قال ابن العربي : وأما الخضاب فهو من الزينة الباطنة إذا كان في القدمين .[ ص: 213 ] السادسة : قوله تعالى : وليضربن بخمرهن على جيوبهن قرأ الجمهور بسكون اللام التي هي للأمر . وقرأ أبو عمرو في رواية ابن عباس بكسرها على الأصل ؛ لأن الأصل في لام الأمر الكسر ، وحذفت الكسرة لثقلها ، وإنما تسكينها لتسكين عضد وفخذ . و ( يضربن ) في موضع جزم بالأمر ، إلا أنه بني على حالة واحدة إتباعا للماضي عند سيبويه . وسبب هذه الآية أن النساء كن في ذلك الزمان إذا غطين رءوسهن بالأخمرة وهي المقانع سدلنها من وراء الظهر . قال النقاش : كما يصنع النبط ؛ فيبقى النحر والعنق والأذنان لا ستر على ذلك ؛ فأمر الله تعالى بلي الخمار على الجيوب ، وهيئة ذلك أن تضرب المرأة بخمارها على جيبها لتستر صدرها . روى البخاري ، عن عائشة أنها قالت : رحم الله نساء المهاجرات الأول ؛ لما نزل : وليضربن بخمرهن على جيوبهن شققن أزرهن فاختمرن بها . ودخلت على عائشة حفصة بنت أخيها عبد الرحمن - رضي الله عنهم - وقد اختمرت بشيء يشف عن عنقها وما هنالك ؛ فشقته عليها وقالت : إنما يضرب بالكثيف الذي يستر .السابعة : الخمر : جمع الخمار ، وهو ما تغطي به رأسها ؛ ومنه اختمرت المرأة وتخمرت ، وهي حسنة الخمرة . والجيوب : جمع الجيب ، وهو موضع القطع من الدرع والقميص ؛ وهو من الجوب وهو القطع . ومشهور القراءة ضم الجيم من ( جيوبهن ) . وقرأ بعض الكوفيين بكسرها بسبب الياء ؛ كقراءتهم ذلك في : بيوت وشيوخ . والنحويون القدماء لا يجيزون هذه القراءة ويقولون : بيت وبيوت كفلس وفلوس . وقال الزجاج : يجوز على أن تبدل من الضمة كسرة ؛ فأما
