There are some hadiths that speak of some Muslims of that time apostating and the Muslims didn't kill them nor did the Hadith indicate they wanted to.

The fundamentals of Islam are in the Quran and hadith. If it says to throw gays off rooftops or that Jews and Christians must pay jizya, there is no room to differ. There is no "scholar" that believes in equality regardless of religion (and if there is, he can't claim to be Muslim)

Even so, Caliph Omar on his deathbed left the following instruction: “I instruct you to be good to the Dhimmis [non-Muslims] for they are your responsibility. Do not tax them beyond their capacity. Ensure that they pay the Jizya without undue inconvenience…With regard to the people, I enjoin upon you to administer justice with an even hand. See that all the legitimate requirements of the people are met. Be concerned for their welfare. Ensure the safety of their person and property…Treat all the people as equal. Be a pillar of strength for those who are weak and oppressed. Those who are strong but do wrong, make them pay for their wrong-doings.”

Furthermore, if any non-Muslim tribes agreed to serve in the military or agreed to pay the Zakaat (charity which Muslims pay) they were excluded from paying Jizya.

I'm not sure if jizya exist anywhere in the world in present days. But looking at the reason why non Muslims living in a Muslim country required to pay jizya tax in those days make I sense. As some already commented above, for Muslims it is must to pay zakat to poor if they are wealthy and also healthy Muslim men were required to serve in the army whereas, wealthy non Muslims only had to pay jizya only to make it fair for all.

Practical Jurisprudence (fiqh al-waq’i): What is meant by ‘practical jurisprudence’ is the process of applying Shari’ah rulings and dealing with them according to the realities and circumstances that people are living under. This is achieved by having an insight into the realities under which people are living and identifying their problems, struggles, capabilities and what they are subjected to. Quran (9:5) - "So when the sacred months have passed away, then slay the idolaters wherever you find them, and take them captive and besiege them and lie in wait for them in every ambush, then if they repent and keep up prayer and pay the poor-rate, leave their way free to them."

So if you repent, that is best for you; but if you turn away – then know that you will not cause failure to Allah . And give tidings to those who disbelieve of a painful punishment.
9:4 Excepted are those with whom you made a treaty among the polytheists and then they have not been deficient toward you in anything or supported anyone against you; so complete for them their treaty until their term [has ended]. Indeed, Allah loves the righteous [who fear Him].
9:5 And when the sacred months have passed, then kill the polytheists wherever you find them and capture them and besiege them and sit in wait for them at every place of ambush. But if they should repent, establish prayer, and give zakah, let them [go] on their way. Indeed, Allah is Forgiving and Merciful.
9:6 And if any one of the polytheists seeks your protection, then grant him protection so that he may hear the words of Allah. Then deliver him to his place of safety. That is because they are a people who do not know.
9:7 How can there be for the polytheists a treaty in the sight of Allah and with His Messenger, except for those with whom you made a treaty at al-Masjid al-Haram? So as long as they are upright toward you, be upright toward them. Indeed, Allah loves the righteous [who fear Him].
9:8 How [can there be a treaty] while, if they gain dominance over you, they do not observe concerning you any pact of kinship or covenant of protection? They satisfy you with their mouths, but their hearts refuse [compliance], and most of them are defiantly disobedient.
9:9 They have exchanged the signs of Allah for a small price and averted [people] from His way. Indeed, it was evil that they were doing.
9:10 They do not observe toward a believer any pact of kinship or covenant of protection. And it is they who are the transgressors.
9:11 But if they repent, establish prayer, and give zakah, then they are your brothers in religion; and We detail the verses for a people who know.
9:12 And if they break their oaths after their treaty and defame your religion, then fight the leaders of disbelief, for indeed, there are no oaths [sacred] to them; [fight them that] they might cease.
9:13 Would you not fight a people who broke their oaths and determined to expel the Messenger, and they had begun the attack upon you the first time? Do you fear them? But Allah has more right that you should fear Him, if you are [truly] believers.
9:14 Fight them; Allah will punish them by your hands and will disgrace them and give you victory over them and satisfy the breasts of a believing people.

When we read from verse 1, it states that there was a treaty which the Pagan Arabs broke. Thus, Allah in the Quran says, that HE gave them four months. Verse 9:4 states that Allah will punish those who broke the treaty, this verse is only aimed at those who broke the treaty, it did not affect those who abided by the treaty. When we read the passage (9:5), it is evident, it’s talking about a war with the pagan Arabs. This was a historical event that happened in the lifetime of Prophet Muhammad (p). Furthermore, verse 9:13 provides proof that it was the pagans who started this war. The verse states, “Would you not fight a people who broke their oaths and determined to expel the Messenger, and they had begun to attack you first?” This is proof that Prophet Muhammad (p) did not start this war, but it was those treacherous pagan Arabs that started to expel and fight the Messenger.

Quran (9:20) - "Those who believe, and have left their homes and striven with their wealth and their lives in Allah's way are of much greater worth in Allah's sight. These are they who are triumphant." This doesn't say to fight those that come to you but to leave your house.

Indeed you are correct this verse instead is about leaving your homes , your countries in search for a life in the way of Allah for example if one is being oppressed in a land to migrate out of that land so that it become easier for you to live by the way of Allah. your point?


Quran (9:38-39) - "O ye who believe! what is the matter with you, that, when ye are asked to go forth in the cause of Allah, ye cling heavily to the earth? Do ye prefer the life of this world to the Hereafter? Doesn't seem very defensive

[9:38] Believers!38 What is amiss with you that when it is said to you: "March forth in the cause of Allah," you cling heavily to the earth? Do you prefer the worldly life to the Hereafter? Know well that all the enjoyment of this world, in comparison with the Hereafter, is trivial.39

38. From here begins the discourse (Ayats 38-72) which was sent down at the time when the Prophet (peace be upon him) was engaged in making preparations for the campaign to Tabuk.



39. “The enjoyment of the life of this world” may imply two meanings. First: “When you will find that the life in the Hereafter is eternal and see that the good things and the provisions of enjoyment are countless, you will realize that the potential and the actual enjoyments of the temporary life of this world were nothing as compared with the blessings of that great kingdom. At that time you will regret why you deprived yourselves of this everlasting happiness and bliss for the sake of a very little and short lived enjoyments of the mortal life of this world.” Second: “The goods of this worldly life are of no value in the Hereafter, howsoever abundant they might be. You shall have to give up each and everything as soon as you breathe your last. For nothing of this world can go with you to the next world. Of course, you will get credit for what you sacrificed for the pleasure and love of Allah, and love of Islam.”

اِلَّا تَـنۡفِرُوۡا يُعَذِّبۡكُمۡ عَذَابًا اَلِيۡمًا   ۙ وَّيَسۡتَبۡدِلۡ قَوۡمًا غَيۡرَكُمۡ وَلَا تَضُرُّوۡهُ شَيۡـئًـا ؕ وَاللّٰهُ عَلٰى كُلِّ شَىۡءٍ قَدِيۡرٌ‏ 
[9:39] If you do not march forth, Allah will chastise you grievously40 and will replace you by another people,41 while you will in no way be able to harm Him. Allah has power over everything.


40. A general rule of the Islamic conduct has been derived from, “If you do not go forth, He will punish you with a painful punishment.” When the Muslims are commanded to go to Jihad by a public proclamation from their leader, it becomes an obligatory duty for those who are called upon to do Jihad, whether they belong to any particular group or region. So much so that the faith of those who do not go for Jihad without a genuine excuse becomes doubtful. But even in cases where the Muslims are called upon to go forth for Jihad and there is no command for the compulsory enrollment of every able-bodied Muslim of a particular group or region, it is a religious duty (though not obligatory), and it shall be considered to have been performed even if only some Muslims go forth for it.


As we have discussed previously Jihad is only permissible when one is attacked its not jihad when YOU are the transgressor , therefore with this in mind , the muslims are being instructed to not fear the enemy and instead to go out and fight those that want nothing but to harm them , this verse highlights human nature and the obvious is that the muslims were afraid for their lives and this ayat from Allah was to instill morale int he muslim army (of 300) against the army of quraysh and the jews 1,000+). 41. That is, “Allah’s work does not depend on you and will be accomplished only if you do it. It is Allah’s grace and bounty that He is affording you the golden opportunity of serving the cause of His Way. Therefore if you miss this opportunity because of any foolish assumption, Allah will raise another people and bestow on them the opportunity and capability of doing His work, and you will be losers”.

[9:40] It will matter little if you do not help the Prophet, for Allah surely helped him when the unbelievers drove him out of his home and he was but one of the two when they were in the cave, and when he said to his companion: "Do not grieve. Allah is with us."42 Then Allah caused His tranquillity to descend upon him, and supported him with hosts you did not see, He humbled the word of the unbelievers. As for Allah's Word, it is inherently uppermost. Allah is All-Powerful, All-Wise.


42. This refers to the occasion when the disbelievers had decided to assassinate the Prophet (peace be upon him), and the very night, fixed for his assassination, he had left Makkah for Al-Madinah. By that time most of the Muslims had migrated to Al-Madinah in twos and threes and only a few helpless ones had remained behind in Makkah. As he was sure that he would be pursued, he took only Abu Bakr (may Allah be pleased with him) with him and went southward instead of following the northern route to Al- Madinah and remained hidden in the Thaur cave for three days. In the meantime the blood thirsty enemies had begun to make a thorough search for him all around Makkah and some of them reached the very mouth of the cave where he was hidden. On this critical occasion Abu Bakr (may Allah be pleased with him) naturally felt alarmed lest they should peep into the cave, and see them. But the Prophet (peace be upon him) remained as calm as before and reassured his companion, saying, “Do not grieve, indeed Allah is with us.”

Quran (17:16) - "And when We wish to destroy a town, We send Our commandment to the people of it who lead easy lives, but they transgress therein; thus the word proves true against it, so We destroy it with utter destruction."

Really?! You believe this? In a society where Sharia is fully implemented, Christian/jewish places of worship cannot be built and old ones cannot be repaired. People of the Scripture: Regarding Arab Christians, you gave them three choices: jizyah (poll tax), the sword, or conversion to Islam. You painted their homes red, destroyed their churches, and in some cases, looted their homes and property. You killed some of them and caused many others to flee their homes with nothing but their lives and the clothes on their backs. These Christians are not combatants against Islam or transgressors against it, indeed they are friends, neighbours and co- citizens. From the legal perspective of Shari’ah they all fall under ancient agreements that are around 1400 years old, and the rulings of jihad do not apply to them. Some of their ancestors fought alongside the Prophet’s  army against the Byzantines; and thus have been citizens of the State of Medina since that time. Others are under agreements that were guaranteed to them by Omar ibn Al- Khattab, Khalid ibn Al-Walid, the Umayyads, the Abbasids, the Ottomans and their respective states. In short, they are not strangers to these lands, but rather, of the native peoples of these lands from pre-Islamic times; they are not enemies but friends. For the past 1400 years they have defended their countries against the Crusaders, colonialists, Israel and other wars, how, then, can you treat them as enemies? God  says in the Qur’an: ‘God does not forbid you in regard to those who did not wage war against you on account of religion and did not expel you from your homes, that you should treat them kindly and deal with them justly. Assuredly God loves the just.’ (Al- Mumtahanah, 60: 8).

That hadith has been debunked long ago , also children being beaten if they don't learn or pray by age 7 what nonsense , now your just waffling . Aisha's marriage to the prophet was ad vine one and even till this day we are truly unsure of her age , as different hadith suggest she was either 14, 19 or most commonly 9. Slavery: No scholar of Islam disputes that one of Islam’s aims is to abolish slavery. The Prophet  said regarding the pre-Islamic ‘League of the Virtuous’ (hilf al- fudul) during the time of Jahiliyyah: ‘Had I been asked to fulfil it in Islam, I would oblige46.’ After a century of Muslim consensus on the prohibition of slavery, you have violated this; you have taken women as concubines and thus revived strife and sedition (fitnah), and corruption and lewdness on the earth. You have resuscitated something that the Shari’ah has worked tirelessly to undo and has been considered forbidden by consensus for over a century. Indeed all the Muslim countries in the world are signatories of anti-slavery conventions. God  says: ‘... And fulfil the covenant. Indeed the covenant will be enquired into.’ (Al-Isra’, 17: 34) You bear the responsibility of this great crime and all the reactions which this may lead to against all Muslims.

It is known that the verse: ‘There is no compulsion in religion’ was revealed after the Conquest of Mecca, hence, no one can claim that it was abrogated. You have coerced people to convert to Islam just as you have coerced Muslims to accept your views. You also coerce everyone living under your control in every matter, great or small, even in matters which are between the individual and God . In Al-Raqqa, Deir el-Zor and other areas under your control, armed groups who call themselves ‘al-hisbah’ make their rounds, taking people to task as though they were assigned by God  to execute His commandments. Yet, not a single one of the Companions did this. This is not enjoining the right and honourable and forbidding the wrong; rather, it is coercion, assault, and constant, random intimidation. If God  wanted this, He would have obliged them over the minutest details of His religion. God  says: ‘... Have they not realised, those who believe, that had God willed, He could have guided all mankind? ...’ (Al-Ra’d, 13: 31); and: ‘If We will We will send down to them a sign from the heaven before which their necks will remain bowed in humility.’ (Al-Shu’ara’, 26: 4).

15. Children: You have made children engage in war and killing. Some are taking up arms and others are playing with the severed heads of your victims. Some children have been thrown into the fray of combat and are killing and being killed. In your schools some children are tortured and coerced into doing your bidding and others are being executed. These are crimes against innocents who are so young they are not even morally accountable.
