Shariah has never been law in Somali or among the various Somali people in the horn. We used to wed women who were raped to the rapist, steal livestock from each other for centuries, and kill for the slightest of things. Somali politicians have always been quiet secularists, similar to Egypt in that respect.
The main problem in the Muslim world is that Shariah law has not been codified, and specific punishments assigned to specific violations. This causes huge problems because then you have Qadis who are coming up with their own interpretation for every ruling. It essentially becomes arbitrary. This is the problem faced by every party that wins elections across the Muslim world and then tries to bring in Sharia. Somalia is getting better but it is still a very fragile country, I think it is too soon to start overhauling a judicial system under these circumstances. Besides Somalia has no strong ruler to apply sharia, anyone who tries to apply sharia in a failed state does not understand the religion.
