Secondly, DNA testing via the semen, pubic hair or skin left on the victim is beyond reasonable doubt unless it is tampered with during testing. Even when that happens, a new testing could be done which absolves or incriminates the accused. Malaysia and Indonesia both use it with the tacit approval of their ullemma that it strengthens the spirits of the law under Islamic law. Why would 4 people watch a rape taking place? Glad that you mentioned that, do you know that Somalia, Somaliland and Jibouti introduced the Radio before Saudi Arabia because the Saudi Islamic scholars issued edicts banning it and claiming it was the devils messages. Do you know how king Saud convinced them? He broadcasted a Koran reading on Radio and made them listen & also argued that it will help with Da’wa3 to spread Islam. Radio was first introduced into Somalia by the Italians in 1938, Somaliland by the British in 1943 and in Saudi Arabia in 1949 because of the resistance of their Islamic scholars. We should look up to the Egyptian Islamic scholars who are trained in a robistic cross multi disciplinary education system. The education system in Saudi Arabia waa qasaaro.

Rape in Islamic Law is left to the judge to investigate and give the sentence. It does not come under Zina.
There is the opinion of which if the woman has a bad reputation and claims rape, she must provide evidence of witnesses. If it is a woman of good character, then the judge must take her account and look for other evidences(clothes,blood,trail etr). Her account must be strong to prove it happened and then 4 witnesses are not required.
Once proven, the death sentence is to be handed down aswell the family paying 100 camels in compensation

Somalia has joined the civilised world in convicting rapists by using DNA evidence for the first time. Is this haram because there must be four eyewitnesses to the rape taking place under Shariah? In first for Somalia, DNA used to convict rapists .

The Bureau of Forensic Science said in a statement that Somalia had "joined, for the first time, the rest of the world in utilising science to solve a heinous criminal case".

MOGADISHU (AFP) - Somalia has for the first time used DNA evidence to obtain a criminal conviction, sentencing three men to death on Sunday for the gang-rape and murder of a 12-year-old girl, the Bureau of Forensic Science said.

The country got its first-ever forensic laboratory in 2017 in the semiautonomous state of Puntland, seeking to tackle widespread sexual violence in a country where two decades of conflict and turmoil have put justice out of reach for most.

The bureau said in a statement that Somalia had "joined, for the first time, the rest of the world in utilising science to solve a heinous criminal case".

In February, the kidnapping of 12-year-old Aisha Ilyas Adan - who was gang-raped and tortured to death, her body dumped outside her parents home - sparked outrage and protests in the region.

Human Rights Watch has described rape as "normal" in Somalia, with police often failing to take cases seriously.

The Puntland state government enacted a Sexual Offences Act in 2016, which criminalised sexual offences and imposed tough penalties.

The central government in Mogadishu is still working on adopting Somalia's first-ever national rape laws, with a new Sexual Offences Act adopted by ministers in May 2018. It still needs approval by parliament.



About 10 suspects were arrested in connection with Adan's rape and murder.

State prosecutors said 37 DNA samples were taken from the suspects and stored in the lab, which cannot at present analyse such material.

The samples were sent to neighbouring Kenya for processing, which linked three of the suspects to the crime.

High court judge Abdinur Jama Hussein on Sunday sentenced the three "to the death penalty for kidnapping, raping, and murdering Aisha Ilyas."

In Somalia, the death penalty is carried out by firing squad.

DNA is as solid as four witnesses seeing the rape. The reason the four witnesses is to ensure no one is accused of rape easily. Also, nothing in Sharia law says if there are no witnesses rape did not happen. Proving something happened is not the same as denying it happened. Torn clothes, physical wounds, many things people can observe can be used to assess a crime happened.

Keep an open mind saxib. It is not always what you assume about Islam. People wrote volumes of law understood from Quran and Sunnah. And schools of jurisprudence are born out of figuring the details of laws relating to spirituality, civic and criminal laws.

These elders could be the anchor of society if they were decent. They are good use when they are upright, just and honest Muslims. Their status would strengthen the just causes of our society. Unfortunately, most of them are unlettered or powerless against established corrupt elites. They depend on the existing system and the system depends on them for legitimacy. Self assured destruction, mutual in relations and outright disgusting.

These elders would be our heroes if they were brave patriotic men who keep in check the corrupt men in their clans. Young men and women would rally around them and hang the bad dudes who made Somalia suffer in public squares for a lesson to all would be national disgraces out there waiting for their turn.

I met a Somali professor who teaches biology at our local university. He is young and came here in his teens. Has two Phds, one in biochemistry one in Biology, speaks Somali fluent and is in his early 40s. We can't kill someone like that.

The trolls on this website who seem to wake up from the gutter every morning and who spew clan bigotry, some women included with no shame are much worse than many 40 year Olds I met who are outstanding citizens.

So, age categorization is not perfect. It is where every Somali spends most time and with whom that need fixing, many households stink of hypocrisy, national disgrace. WE ARE ALL REFLECTIONS OF OUR HOMES.

I don't know how someone can be on welfare and pretend they are anything. Instead of hanging their heads low and build their character and people, regain the lost dignity and be an example, they are using modern day amenities like the internet to expose the savagery that ruined our country to foreigners and readers of Somali websites.
