Why force a 22 year old man to marry your 15 year old daughter?

Father on trial for Vic forced marriage.

A 15-year-old Melbourne bride married under sharia law was forced into the union by her father, a jury has heard.

But the 44-year-old dad, who cannot be named for legal reasons, denies arranging a forced marriage, instead insisting the pair were celebrating an "engagement ceremony" in January 2015.

He has been charged with the federal crime of causing a person to enter into a forced marriage and his County Court trial started on Thursday.


The girl, at age 14, met her future husband online, and in November 2014, the couple introduced each other to their families.

Within weeks, when she was 15 and he was 22, they were married by an imam at the Greenvale Recreation Centre, prosecutor Shaun Ginsbourg told the court.

Snippets of a wedding video played to the court showed the girl dressed in a yellow gown, the pair holding hands and posing for photos.

"The imam speaks to the bride and groom separately but that is consistent with a wedding conducted in accordance with sharia laws. There is smoke and mirrors achieved through the editing of the video," Mr Ginsbourg said.

The prosecutor went on to outline that the man was first forced into the marriage during a visit to the accused's home, where the father brandished a large knife.

"It's alleged (the accused) yelled out he wanted 'to behead him'," Mr Ginsbourg said.

The younger man fled and the accused "basically smashed up his car".

On another occasion, the accused told the man he "had to pay $12,000 or marry his daughter" while threatening to kill him, it is alleged.

The younger man did not want to, but agreed because he did not have the money. He later told relatives he felt forced into the marriage.

After the wedding, while the groom was living in the accused's home, he "forced (the victim) to sign an IOU for $450,000" to be "used as a dowry letter", Mr Ginsbourg said.

The husband tried to run at least once from the home as threats were allegedly made to his family and friends. In 2015 he fled to Queensland.

The girl is alleged to have gone to an Islamic celebrant to get a divorce, which the pair is signed on November 30, 2015.

The father's lawyer Peter Kilduff said the accused "denies the charge, he denies that he ever threatened (the victim)" and insists the younger man was never forced in to the marriage.

"The defence will say it was an engagement ceremony," he said.

Mr Kilduff urged jurors to keep an open mind when considering the case.

"You cannot be prejudicial against Islamic law ... you cannot be prejudicial against sharia Law," he urged.

The trial continues on Friday.

Groom sentenced in Australian-first child bride case.

A man has been sentenced to 12 months in prison for illegally marrying a 14-year-old bride in an Islamic wedding in Melbourne last year.

The Burmese asylum seeker was handed a maximum sentence of 18 months but was given a 12-month release date.

He has already spent nearly a year in custody so will be returned to immigration detention indefinitely on his release in a fortnight.

The man cannot be sent back to Myanmar as he is a member of persecuted minority.

It is the first prosecution in Australia under the laws since they were established in 2013.

Judge Lisa Hannan told the man he clearly knew what he was doing was wrong.

"You knew what you were doing was contravening the law of this country and proceeded in the face of advice to that effect," she said.

The man, aged in his 30s, had pleaded guilty to going through a formal ceremony of marriage with a person not of marriageable age at Noble Park last September.

He and his bride cannot be identified for legal reasons.

At a pre-sentencing hearing on Wednesday, the man's defence lawyer, Sophie Parsons, said the girl's mother had been behind the wedding.

Ms Parsons told the court the girl had been having difficulties with her stepfather and her groom saw himself as "rescuing the [girl] and becoming the supportive figure in her life".

The man cried during most of the pre-sentencing hearing and was in tears in court again today.

Ms Parsons said the man, who became friends with the bride when he was living as a boarder in the same house as her, was "culturally isolated".

The man was living in Melbourne on a bridging visa at the time of the wedding.

He was vulnerable to the reassurances of the girl's mother and the imam that married the pair, Ms Parsons said.

The imam, Ibrahim Omerdic, was later convicted and jailed for two months for his role in the illegal ceremony.

He was filmed telling the couple he could not give them a copy of the marriage certificate as the girl was "very young".

On footage played during the court proceedings, Omerdic could be heard confirming the man had handed over $1,480 worth of gold as a traditional form of payment to the bride's family.

Supreme Court Justice Andrew Keogh dismissed the appeal on Friday, saying the magistrate was entitled to find Omerdic had wed the pair.

"I have found against Mr Omerdic on each of the grounds of appeal," he said.

"The appeal will be dismissed."

Omerdic, whose conviction will stand, did not attend the brief judgment hearing.

He was sentenced by magistrate Phillip Goldberg to two months in prison but he was spared immediate jail time.

That's because he was placed on a two-year recognisance release order, effectively suspending the sentence.

Footage of the marriage ceremony at Noble Park has previously been played to court.

"As a wife you have a duty to obey your husband,' Omerdic says in the shaky mobile footage.

"A man is the ruler in his family ... a woman is the ruler in the house of her husband."

He can also be heard telling the child's mother and her betrothed: "She's very young."

Omerdic was an imam of the Bosnian Islamic Society and Noble Park Mosque but was suspended after his November arrest.

MARK COLVIN: A leading figure in Australia's Bosnian Islamic community has welcomed the closure of the controversial Al-Furqan Islamic Information Centre in Melbourne.

He says the centre had kidnapped and brainwashed his community's youth.

The centre has been linked to two teenagers who were recently charged over plots to attack police and the public on Anzac Day.

Alison Caldwell reports.

ALISON CALDWELL: It promoted itself as a religious bookshop and hosted lectures on Islam.

But the Al-Furqan Islamic Information Centre has been linked to a number of Australians who've headed overseas to fight with extremists.

The self-styled Islamic preacher from Perth Junaid Thorne has delivered sermons at the centre.

He mourned its closure on social media this morning.

ALISON CALDWELL: The Al-Furqan Centre was back in the news last weekend, after police conducted counter-terrorism raids on homes in Melbourne's south-east.

Two of the teenagers charged in relation to the alleged Anzac Day terror plot, 18-year-olds Sevdet Besim and Harun Causevic, both visited and prayed at the centre.

So did 18-year-old Numan Haider, who was killed by counter-terrorism police after he attacked them with a knife in September last year.

The centre closed its doors citing constant harassment from the media and from politicians.

The secretary of the Islamic Council of Victoria Kuranda Seyit believes the centre was marginalised.

KURANDA SEYIT: I think that isolating a group is not in the benefit of community, or social cohesion. So yeah, we really just probably in the process of trying to build that relationship and support the organisation so that we don't get a situation where it would you know, potentially go underground, or continue its activities on a more dangerous level.

ALISON CALDWELL: Four of the five men who were arrested last Saturday have Bosnian heritage.

Jasmin Bekric is the chairman of the Bosnian Islamic Council of Australia. He welcomes the centre's closure.

JASMIN BEKRIC: At this moment that's the best, that's the best solution.

ALISON CALDWELL: Describing it as extremist, Jasmin Bekric says the Al-Furqan Centre had kidnapped and brainwashed his community's youth.

JASMIN BEKRIC: They kidnapped and yeah, brainwashed our youth. They are approaching them, their interpretation of Islam is the hard way, and we would like to call all of the youth to come and to be educated in our traditional Bosnian interpretation of Islam.

ALISON CALDWELL: Are you worried though that perhaps it will make some people feel alienated?

JASMIN BEKRIC: I don't think so, I don't think so. We will work hard, we will work very hard with our Bosnians, Australian Bosnians, especially our youth, and we instructed our Imams in Melbourne to work very hard and very close with them. Of course no-one can control what could happen, but we will work very hard to stop any unwanted problems or issues.

This is a bizarre story. It is as if the groom is the bride of the father in law. The poor little 14 year old is irrelevant in this story. Aussie I want to visit weird crazy humid Australia but i cant tolerate the long flight., I will wait until they invent star trek type vessels.
