This is the best chance Banadir has got. It can’t be wasted. Strong FGS, HAG Pres + supportive speakers + easily controlled SL/GM/HS/KG MPs + weakened PL.

The problem with giving Banadir representation in the senate is directly linked to the fact that the constitution has not been amended and passed by both houses.

In order for Mogadishu to have representation in the Upper House these articles need to be amended:

Article 49 Sec. 6

Based on a voluntary decision, two or more regions may merge to form a Federal Member State.

Article 72 preamble

The members of the Upper House of the Federal Parliament shall be elected through a direct, secret and free ballot by the people of the Federal Member States, and their number shall be no more than 54 members based on the eighteen (18) regions that existed in Somalia before 1991.

Article 72 Sec. b

All Federal Member States should have an equal number of representatives in the Upper House of the Federal Parliament.

These are changes that have to be made anyway since Galmudug also fails to fulfil the 2 state requirement and is not in compliance. Also the requirement that all states should have an equal number of senators was violated when Puntland & Somaliland received more representation, they are not in compliance.

By giving PL & SL more representation based on their size, parliament admitted that size & population play a role in determining how many senators a federal state can receive. If this formula is to be used nationwide, a census is necessary. Parliament is just estimating that Pl & SL deserve more representation, there is no legal basis.

Parliament knew in 2016, when it was dividing up senate seats, that Banadir would be left out until its situation was clarified. So to maintain the clan balance it gave Galmudug and Hiirshabelle 16 seats, when they should have gotten roughly 10 seats. Hawiye now control 16/54 or ~30% of the senate, so it is not underrepresented as a clan. Any new representation for Banadir would need to be taken from Galmudug & Hiirshabelle.

Trying to amend the constitution so that Banadir has representation would mean that the federal government has to amend 3 sensitive articles of the constitution at once. Hard to imagine this getting done.
