You basically need either a witness to the r*pe or a confession for the charges to stick.
Sexual assaults is one of the hardest crimes to go to jail for. That’s why everyone who has ever been accused always goes “I’m gonna sue” cos it’s difficult to prove.
They didnt attempt to file any charges against him they just posted the accusation on Twitter
There’s no point in filing any charges for sexual assault. Even the police tell victims of its futility.
In the off chance the police can verify that some assault happened, that will be thrown out as it’s not beyond reasonable doubt.
Why go through the stress and exposure of a public trial just to have it thrown out.
I’m not even joking when I say social media is more fair.
Nah man I don’t agree with that, accusing someone with something so serious as sexual assault you need to go file a report and press charges bringing proof backing your claim in the court.
You can’t bust a tweet out saying this nigga raped me and expect everybody to believe you with no proof or police report. On social media the stance is always believe the victim, how if that fair for the accused person ? Read the comments on the TikTok, there were users who asked for proof and they didn’t provide any instead they insulted them and called them victim blamers.
Social media is biased on the side of the victim, that’s why court is fair because you are innocent until you can prove me that I am guilty.
No matter how flawed you claim the justice system is you still need to follow it and present your case. This accusation ruins mens lives and reputation even if they were found innocent they will still be remembered as the nigga who supposedly raped a girl.
You need to take emotion out of this and look at it rationally.
Courts are innocent until proven guilty beyond reasonable doubt.
In the case of sexual assault, that means either a confession or a witness to the assault. Because anything less can be argued as “consensual intercourse” by the defendant.
The “beyond reasonable doubt” was primarily put in place because a guilty verdict was quite literally a death sentence to be carried out immediately, once upon a time.
My conscience can live with falsely accusing someone of being rapist until I believe they are either innocent or the accusers story does not add up.
That’s because the alternative is ignoring sexual assault survivors who did nothing more than be victims.
I don’t know about you but I cannot live with the second scenario.
