Islamic ruling: what happens when a kafir kills a muslim?

A friend of mine was killed by a drunk driver, while my friend was at a red light. What is the Islamic ruling on justice against the kafir?

the kafir has no money, and is only serving 5-7 years in prison. I feel powerless.
