This proves you haven't studied much walaal. Sharia means law. To be a Muslim you have to believe in the five pillars of Islam and there is no "Sharia" in there.

What a dumb statement is this! To be a Muslim you need to believe in the 5 pillars of Islam, the 6 pillars of Iman and you also need to stay away from everything that Nullifies your Islam. Denying the existence of the Jinn or Angels for example will make you an unbeliever and it's not part of the 5 pillars of Islam.

It’s not realistic in this day and age. You’ll always have ppl disagreeing over how harsh or lenient it is. It’ll create khawarij elements.

I support our laws not clashing against Islamic sharia. However the state should be separate from religion in that we have a religious council that protects from any laws that are against Islamic sharia however our government should not be run on political Islam

So if the five pillars are sharia, why were Christians allowed freedom who don’t follow the five pillars? This proves their is a common law that binds the citizens regardless of religion. Allah does not tell us exactly how to govern but he legislates morality and ethics which we can use that as a base for our constitution.

The five pillars(praying five times a day, fasting...) are part of the Shariah; so is taking Jizya from conquered Christians. Both legislations are obtained from the scriptures of Islam, the Quran & Hadith.

Allah ﷻ through his prophet ﷺ taught us exactly how to treat criminals, how to deal with the Gaalo... etc. Allah has also warned us not to govern other than what he legislated for us.

Allah ﷻ said to the prophet ﷺ in Quran 5:49,50

"So judge between them by what Allah has revealed, and follow not their vain desires, diverging away from the truth that has come to you. To each among you, We have prescribed a law and a clear way."

The jizya is something specific to gaalo who don’t have to follow the five pillars. Hence not all of Islam is “sharia” Islam legislates the sharia.

For crimes like claiming someone has committed homosexual acts you need 4 eye witnesses who saw the act of penetration. Those 4 eye witnesses have to be credible and reliable witnesses. They all have to say the same story if 1 says something different the case gets thrown out. Also spying is a sin in islam. Thats why its more of an deterrent than anything else as for some to fit all those criteria's you have to be fucking in public or something
