Child marriages are legal in the United states

Surprisingly “Child marriages” are actually legal in the United States with parental and Judicial consent. Although the age of consent is at 18, there’s no minimum age of marriage in most states. So if you wanted to marry an 11 year old, it’s legal with parental and Judicial consent. It’s been estimated that 200,000 minors have been married off legally. An 11 year old Black girl was legally married to a guy in her 20s and had 5 children by 16.

What’s laughable is America is fighting other countries with this problem even though minor marriages exist in their own country.



 
How can a man be attracted to a girl whose body and mind isn't fully developed. If I was a man, i'd be drawn to womanly curves or womanly energy, not a child who still smells like breastmilk, uff.

In Yemen, these pedophilic men, marry young girls who end up bleeding to death from intercourse. Instead of learning a lesson from this, they continue screwing little girls to death under the guise of 'tradition'.

The prophet SAW's other wives were either far older than him; Khadijah RA or he married widows. His marriage choices were wise and not driven by lowly lust.

But I don't think they can do sex with the child after marriage. It is still legal to do sex with child

Her age isn’t disputed but she lived in an environment where once you reach puberty, you weren’t considered a child no more but an adult and young adult marriages were normal. Many grandmothers today were married at a young age and they look down on our generations for marrying at 18 or in their 20s. In pre modern societies, the age of consent was a lot lower than today and varied depending on the society

Although Islam (like all religions) doesn’t have an age limit for consummation, Islam says the marriage cannot be consummated until she’s physically ready and mature enough and there’s no harm involved. If a girl is too small and consummation would be harmful, consummation of that marriage is haram.

Ubadah ibn al-Samit رضي الله عنه reported: The Messenger of Allah ﷺ issued a decree, “Do not cause harm or return harm.” (Sunan Ibn Mājah 2340)

Abu Sa’id al-Khudri رضي الله عنه reported: The Messenger of Allah ﷺ said, “Do not cause harm or return harm. Whoever harms others, Allah will harm him. Whoever is harsh with others, Allah will be harsh with him.” (al-Sunan al-Kubrá 11070)

The Maliki Jurist Ibn Battal said:

“It is not permitted for her husbands to consummate the marriage except if she is capable the sexual affairs and can afford men’s (sexual desire).
The state of each woman differs (from one to another) in this matter according to their capability and endurance.”

Ibn Battal, Sharh Sahih al-Bukhari, Vol. 7, pp. 172-173

Imam Nawawi narrated this is the view of the three Imams of Fiqh; i.e. Abu Hanifah, Shafi’i, and Malik:


“Malik, Shafi’i and Abu Hanifah said: The is measured by her capability of the sexual relationship and it varies from individual to individual and it is not limited to a certain age.”

Sharh Sahih Muslim, Vol. 9, p. 206

In a collective work of contemporary jurist committee, scholars argue if the bride is not capable of sexual relations, the marriage can’t be consummated regardless of her age:

If she is skinny and feeble, not capable of sexual relation and she may be medically harmed (by doing so), the husband is not permitted to consummate the marriage, even if she is old.”

Al-Fatawa al-Hindiyah, Vol. 1, p. 287

Ibn Battal writes:


“The scholars agreed that it is permissible for fathers to marry off their young daughters even if they are in the cradle, except it is not permissible for their husbands to consummate the marriage with them until they are prepared to safely have intercourse.”

Sharh Sahih al-Bukhari 7/172

That scholars allowed contracting a marriage to child did not mean they allowed sex with children. Physical maturity and safety were the prerequisites for lawful intercourse.

Imam Nawawi writes:

“Know that Al-Shafi’i and his companions encouraged a father or grandfather not to marry off a virgin girl until she reaches maturity and he obtains her consent, that she may not be trapped with a husband she dislikes.”

Sharh al-Nawawi ‘ala Sahih Muslim 1422

Allah does not condone the harming of girls and not obtaining their permission to be married.

even with a mature and ready woman, a man has to be careful and ensure he 'warms' up her body and doesn't just seek his own gratification.

I feel that Muslims need Islamic Sexual education when they reach puberty, I am sure this would stop the demonic FGM practise.

In Puntland, FGM, which as you know is genital mutilation from Pharoanic times, was banned but then some elders and 'islamic scholars' started saying that women should be circumcised. Where in Islam does it say a woman needs to be circumsized? Any idea where they got this from?

I’m not an expert in this topic and correct me if I’m wrong but I think there’s a difference between female genital mutilation and female circumcision. Female circumcision is cutting the tiny tip (this wouldn’t be harmful) and it’s not obligatory whereas FGM is cutting the whole section or most of it and this would be dangerous.

Maybe Somalis are not experts in this field and they don’t know what they’re doing, which is why many girls healths are put at risk.

It's disturbing how Muslims cling onto Pagan beliefs and prejudices even though we claim to be Muslim. What's telling is that Somali Scholars and 'influential' people, still call for women to be circumsized with the FGM ban, even though it's not obligatory.

I think we underestimate how much Paganism is left in Muslim Societies.
