Judges upheld order issued last week to prevent 90-day travel ban from seven Muslim-majority countries and 120-day freeze on US admission of any refugees

In its unanimous ruling, the three judges on the ninth circuit court of appeals upheld the temporary restraining order, which was issued by Judge James Robart, a federal district court judge in Washington state, and has blocked the enforcement of many key parts of the executive order.

The court found that “the government has not shown a stay is necessarily to avoid irreparable injury.” In particular, its ruling noted “the government has pointed no evidence that any alien from any of the countries named in the order has perpetrated a terrorist attack in the United States. Rather than present evidence to explain the need for the executive order, the government has taken the position that we must not review its decision at all.”

For those who are worried about Donald Trump should be put to ease by the strength of the judicial system of the United States that has put the most powerful man in his place. I wish this for Somalia in its road for peace and prosperity.

I am ecstatic.

Around November 8th and January 20th I literally had sleepless nights because of this Trump fucker. Now I am totally relieved from me possibly getting banned.

The 9th circus is a liberal court that has the highest rate of cases struck down by the Supreme Court so don't celebrate yet.
This isn't about liberal or conservative. The travel ban in it's current form is literally unconstitutional. Unless it's changed drastically (which Trump won't do) it will almost certainly be struck down.

The problem with this is that the executive order doesn't come across as unconstitutional only because it doesn't really show any signs of it being unconstitutional. The listed nations are those marked as dangerous by the Obama administration and it doesn't point towards Muslims as 85% of them are not effected. However, Trump has clearly made it abundant that it's a Muslim ban during his candidacy and during when the executive order was being passed. This was corroborated by the Whitehouse spokesman. The real question is, will the Supreme Court accept motive as evidence or not?

They way that they're carrying it out is definitely unconstitutional. If they banned all the people from these countries it's one thing. But they're also making exemptions for Christians from these same countries.

The doesn't even take into account the fact that the majority of terrorist attacks in the US would not have been prevented by this ban. So even the safety argument falls flat.

Yeah, I agree but it depends on whether or not external claims can be accepted as evidence for motive. The security threat argument was completely dismantled by the fact that the Trump lawyers argued that their position is not reviewable because of 'national security'. Anyways, Donald Trump look like he's going to abandon this executive order. It's become clear that this was completely a shambles.
 
It's not unconstitutional because the president's powers cover the right to admit or refuse immigrants from any nation. The only thing that might be unconstitutional is a religious test where Christians and other non-muslims might get exemptions but that's not the case in the executive order he issued. Even Syrian or Iraqi Christians refugees are not being admitted.

Even Syrian or Iraqi Christians refugees are not being admitted.

That's somewhat true because the president has access to classified security information, however Trump called for a complete shutdown of Muslims entering the US when he was a candidate, at a time he didn't have access to classified information. He cornered himself with that one.
