After taking control of Mogadishu created the Court of the Union as the principal component in establishing for the city a new and centralized governing structure. The Court of the Union was composed of three courts: a) the highest court of the new court system; b) an appeals court; c) the Court for Returning Forcefully Taken Fixed Assets (Maxkamada Hanti Isu Celinta). Significantly, the ICU officials declared that only individuals with degrees in Shari‘a and qanun could be appointed as judges or administrators at the new Court of the Union. Similarly lawyers (Wakiilu Ad-Dacwa) were also required to be University graduates with specialization in Islamic Law

The ICU despite having it’s roots in localized Shari’a courts run by local elders and wadaads was very formal and bureaucratized by the time it took center stage in 2006. Prospective judges were tested rigorously before they could take up senior positions in the legal system of the courts and University graduates were favored.

Also noteworthy is that from the very start the ICU made returning forcefully misappropriated properties during the civil war among its biggest goals, according to some sources up to 90% of cases during the period were related to this and an entire court was dedicated solely to this issue. Even Abdullahi Yusuf’s relatives would have their properties returned during the ICU’s reign.

It’s very sad that a lot of people try to defame and attack the ICU due to qabiil reasons by labeling them as terrorists, or try to put a spin on things and convince others and themselves that AY was a savior who finally brought the somali federal government back to the moriyaans in Xamar.

The truth should be clear to anyone who has the best interests of the Somali nation at heart. The events in 06 was nothing but an invasion of Somalia, its people and primarily their religion and their right to self governance. It was a regime change because Ethiopia and US/Israel saw the ICU as a threat to their ambitions in the region(and their general agenda of making sure Muslim nations remain weak and subservient).

ICU was never one cohesive unit. It was just an umbrella of old Islamists, Hawiye militia, new school ikhwan type wadaads like sheikhs Shariff and large numbers of young salafi jihadis who were decisive in some of t the key battles. People exaggerate their governance potential.
