Current Citizenzhip Laws in Somalia

Somalia: Whether persons born in Somaliland and in the Ogaden region of Ethiopia are entitled to Somali citizenship; citizenship status of women married to foreign nationals; requirements and procedures to obtain and reacquire Somali citizenship (2015-November 2017)"
Somalia for the W again.

5. Citizenship Status of Women Married to Foreign Nationals
Article 13 of the Law No. 28 of 22 December 1962 on Somali Citizenship provides the following:

Article 13. Married Women

  1. Any woman who is not a citizen and marries a citizen shall acquire Somali citizenship. She shall retain it even after the dissolution of the marriage, except where she renounces her Somali citizenship under the terms of article 10.
  2. Except as provided in paragraph 2 of article 9, any woman who is not a citizen and is the wife of an alien or stateless person who acquires citizenship, shall acquire Somali citizenship.
  3. Any women who is a citizen and marries an alien shall lose her Somali citizenship if, by her marriage, she acquires her husband's citizenship.
  4. Except as provided in paragraph 3 of article 11, any woman who is of marriage shall recover it, if the marriage is dissolved, provided that lose it too, unless the husband has become stateless or the new citizenship acquired by him cannot be extended to her.
  5. Any woman who was a citizen and lost her citizenship because of marriage shall recover it, if the marriage is dissolved, provided that she establishes her residence in the territory of the Somali Republic and renounces any foreign citizenship or status as subject of a foreign country in the manner prescribed in article 6. (Somalia 1962, italics in original)
Paragraph 3 of Article 11 of Law No. 28 of 22 December 1962 on Somali Citizenship provides the following: "[d]eprivation of citizenship acquired by grant shall not extend to the wife and minor children of the person concerned" (Somalia 1962).

To summarize:

1. When a non-Somali man marries a Somali woman, the woman will involuntarily lose her Somali citizenship
2. When a non-Somali woman marries a Somali man, she will automatically become a Somali citizen regardless of her preference;

3. Somali women are not be able to pass their citizenship on to their husbands;

4. Somali mothers cannot pass on citizenship to their children.

No trolling on my thread and no emotional outbursts please. Is this a good thing or a bad thing? Should Somalia change its citizenship laws?

No one is exactly diying to attain somali citizenship. :francis:

A citizenship you can buy in a market for 100$ is worthless.

Citizenship doesn’t matter in a corrupt and poor place like Somalia. Half Somalis can live and thrive there with no problem if they choose to.

They have no qabil no protection. Only mixed children of Somali Fathers are successful in Somalia. Children with Somali mothers and non somali fathers are not accepted. :kanyehmm:

Somalis don’t accept half j4reer kids no matter whose side they’re from. Do you think you as a man can bring your half madow kids to Somalia and they won’t face any ridicule?

But best believe half arab or half cadaan kids are treated decently in Somalia, no matter if the father or mother is Somali. In fact the most common interracial pairing is Yemeni man + Somali woman. And the kids that come from that union are widely accepted and treated well :zhqjlmx:

Refugees aren't citizens with the rights. Even in Saudi Arabia you can be deported any day for not being paternally Saudi.

I don't think not being to own any land or anything would be enticing to me in that qabilist country.

Stop creating false narrative.
Who ever wrote the article has cheap political agenda.

The law is unfair towards women.
If a woman only has the somali citizenship it would illegal under international laws to make her stateless just because she married a non somali.
It is also unfair that Somali mothers cannot pass their citizenship to their children.
I agree with the rest. All ethnic somalis from Kenya, Ethiopia and Djibouti are somali citizens

It's not unfair. Many other countries have this. They can live in the west if they want to marry out the family. There are. Consequences. We cannot except millions of refugees that marry in it would change our country and erase the essence of nations and cultures.

How will life go for those cousins if they ever try and get married in Somalia to other clans women?

How will it go when it comes to becoming a politician?

How will it go when a corrupt officer is trying to estimate how much ge should charge you for a bribe?

How will it go if they try and buy land in another clans area especially since they have no clan territory?

Life is more than insults and perception from strangers there are definitely difficulties that come with making yourself a foreigner(clanless) in your own country. There were Yemenis in Gobweyn and now others eat off of there hardwork when they were forced to abandon there land :liberaltears:
